LafargeHolcim & Cabinet ARC : A Successful Partnership

“ Cabinet ARC really impressed me with the way our working framework was set up, for two reasons: first, we defined the framework together, so we have a charter that we both signed outlining how I want him to handle debt collection; and second, it covers how he is to return the funds to me and how we are to communicate with each other to ensure a quick return of cash.”

So, through this charter, we’ve prioritized digitization. “Digitization means that we no longer send out our invoices; instead, they are retrieved from our website, where we host them. As a result, a number of process optimizations have enabled them to realize cost savings as well, creating a win-win situation for both of us.”

“So the key features are very clearly the ability to develop two types of dispute resolution scenarios: one that is highly legal in nature—that is, immediate legal action—and another that is more flexible, allowing for negotiation and the implementation of moratoriums, always with a focus on supporting the client.”

"But what really impressed me was the legal expertise of the Cabinet ARC —they know how to follow the proper procedures, file the appropriate preliminary injunctions, as they explained, and ensure a quick return of funds."

LafargeHolcim & Cabinet ARC : The Challenges

“Collection challenges are significant, especially in today’s difficult business environment. So there are two key issues: first, the LME, since we have a special exemption agreement ensuring that the payment terms we must enforce under the LME are in effect; and the second challenge is to continue reducing our payment delays while maintaining close ties with our customers, because if a customer, as I mentioned earlier, is facing difficulties, we need to work with them to determine whether these are temporary or significant difficulties.”

The Revolution in the European Order for Payment

Jérôme Mandrillon shares his perspective on debt collection procedures at the European level.

What is your opinion of the new regulations implemented in the European Union?
Jérôme Mandrillon: The elimination of the exequatur procedure is an undeniable step forward for European law, saving a great deal of time in the processing of debt collection requests. But what can truly be considered a revolution is the introduction of the European payment order.

In what way is this a revolution?
J. M.: To tell the truth, the digitization of documents is the real issue at stake: through the certification already offered by organizations such as Certigreffe, it is possible to fill out the application form for a payment order online, and it will soon be easy to complete the process entirely online. This will make the debt collection process and the enforcement of court decisions even more efficient.

At LafargeHolcim, do you use the services of Cabinet Arc ?
J. M.: We have few cross-border disputes, but we are working on various cases with Cabinet ARC. I’ve known this firm for nearly fifteen years and appreciate its professionalism and efficiency. We can count on the lawyers at Cabinet ARC to adapt their approach based on the desired pace for each case, and we can track the situation and the status of ongoing proceedings in real time. I consider Cabinet ARC to be a true long-term partner.
